I have been working on Dr. Lesly Pompy’s story for quite some time and I want to share it with you. I can only hope that you would want to help, who I feel, Is an innocent man. I have here instances and questions we all should be asking

BACKGROUND

In 1991, Richard Whitmer, as the president of Blue Cross Blue Shield of Michigan (BCBSM), signed a Professional Provider Agreement with Dr. Lesly Pompy. In 2013 and under the authorization of the franchisor Blue Cross Blue Shield Association (BCBSA), BCBSM was absorbed by a Mutual Insurance Company incorporated in the State of Michigan, Blue Cross Blue Shield of Michigan Mutual Insurance Company (BCBSMMIC). BCBSMMIC and BCBSM are different legal entities. BCBSMMIC and BCBSM have a duty to follow different Federal and state tax and insurance laws.

Questions

1. Did Marc Moore, William Paul Nichols, Brian Bishop, Zazadny, Zsenyuk, BCBSMMIC, in November 2015, enter into a proprietary, non-discretionary, agreement to violate established laws?

2. Did Shawn Kotch obtain a credit report of Lesly Pompy M.D without consent or privilege?

3. Did BCBSMMIC insert James Howell as an undercover agent into a “Drug Treatment Program“ without the court order required by 42 C.F.R. §§2.61-2.67?

4. Did J. Alan Robertson M.D. provided a medical referral lacking medical necessity to James Stewart aka James Howell?

5. Did Dr. J Alan Robertson provide a medical referral with an intent to deceive?

6. Did the use of defective search warrants, supported by false statements in the affidavits; the use of a private employee of BCBSMMIC James Stewart aka James Howell to act as an agent of the government induce an illegal 4th Amendment search and seizure violation?

7. Did Jon Lasota, Robert Blair, Brian Bishop, acquired medical records pursuant to a jurisdictionally defective third party warrant?

8. Did Jon Lasota, Robert Blair, Brian Bishop, disclose the medical records to BCBSMMIC? Did Carl Christensen, Dr. Pedell, Vaughn Hafner, and/or Jon Lasota disclose such medical records to Bishop, Allison Arnold, William Paul Nichols, Jeffrey Yorkey, Michael Roehrig without notice, in violation of State and Federal HIPAA laws with respect to the maintenance of, and disposition of the medical records, without adequate security or notice?

a. Was James Stewart during the 9/26/2016 warrantless invalid search, allowed to access the name and addresses of patients undergoing substance abuse treatments, who were then identified, and subsequently visited by law enforcement? Was James Stewart aka James Howell to videotape patients in one room while interviewing patients in another?

9. Did the Bureau of Professional Licensing, in furtherance of the conspiracy, obtain a False MAPS report (Michigan automated prescription system), the federal government obtain a false Social Security Card, and the Secretary of State obtain a false State of Michigan Driver’s license? Was the false State of Michigan Driver’s license was used by James Stewart aka James Howell, to illegally: 1) obtain from a Walgreens pharmacy, 2) ingest controlled substances that appeared in his urine, and 3) distributed control substances to Marc Moore who was lacking a DEA Reverse Distribution License?

10. Was there $16, 856,683 Conspiracy when Robert Blair displayed a felonious malicious intent to cover up the 9/23/2016 illegal search warrant, via an 8/13/2017 cover-up pretextual search warrant, proprietary non-discretionary functions, sought $16, 856,683 million via a federal indictment?

11. Did Robert Blair, acting as an agent of the DEA, obtain, use, and reuse, FDIC-insured bank account of Lesly Pompy and other accounts by MBT Financials, in violation of the Gramm-Leach-Bailey Act?

12. Did Brian Bishop violate Federal Rule of Civil Procedure, Rule 4, which prohibits a party in the action to serve Process of Service, when he served Dr. Pompy with a State of Michigan Immediate Suspension Order (ISO) at Promedica Monroe Regional Hospital on 8/4/2017, immediately suspending Dr. Pompy’s State of Michigan medical license?

a. Brian Bishop became a party to a medical license action when he filed a complaint against Dr. Pompy’s Medical license on 9/30/2016

13. Subsequent to Brian Bishop’s violation of Rule 4 of F.R.C. Proc., did Brian Bishop illegally acquire, disclose, redisclose, maintain, and dispose without notice, the plaintiff’s medical records to: Vaughn Hafner, Leon Pedell M.D., Michael St. John, Dina Young, Bill Schuette, Jennifer Fitzgerald, Timothy Erickson, Catherine Waskiewicz, Haley Winans, and Kim Gaedeke?

14. On 4/26/2018 and without consent, privileges, or notice, did Brian Bishop, a party to the litigation surrounding Dr. Pompy’s State of Michigan Medical License, transfer the plaintiff’s medical records, and obtained pursuant to the 9/23/2016 Monroe search warrant to Michael Hendricks?

15. On April 26, 2018, did Brian Bishop transfer electronic devices containing my medical records, pursuant to a 9/23/2016 search warrant? Does the time between the issuance of the search warrant, on 9/23/16, and the 5/23/18 execution of that warrant, constitutes an impermissible, excessive delay?

16. On 5/23/2018, did Matthew Schneider, Wayne Pratt, Brandy McMillion, seek a pretextual search warrant for medical records evidence already in the possession of Michael Hendricks since 4/26/2018? Did Matthew Schneider, Wayne Pratt, Brandy McMillion, filed an affidavit to Judge Laurie Michelson?

17. On or prior to 6/28/2018, did Brandy McMillion, Wayne Pratt, Matthew Schneider use the improperly acquired medical records from the 9/23/2016 search warrant (Case 2:18-cv-13206-DPH-RSW ECF No. 20 filed 11/16/18 PagelD.193 Page 3 of 5), then disclose the medical records to a grand jury so to obtain a federal indictment?

18. A )Were patient records seized though the execution of an Intrastate warrant, instead on an Interstate warrant?

B.)Were the patient records so obtained outside the scope of the warrant, and in violation of the patients’ HIPPA rights?

19. Did DEA Diversion Investigator Brian Bishop transfer Dr. Pompy’s medical records to Michael Hendricks illegally on April 26, 2018?

20. Did Michael Hendricks aquired Dr. Pompy’s medical records on April 26, 2018 prematurely by, without consent or priveledge? If so, could it constitute a violation of the HIPPA Statute?

Gov. Gretchen Whitmer, is this a conflict?

Mike Hawks is the president of the big lobbyist firm ( Government Consultant Services Inc- GCSI) who lobbied the State of Michigan on behalf of Blue Cross Blue Shield of Michigan Mutual Insurance Company.
